What Part of the Executive Order Halting Immigration Applies Only to Those Outside the U.S.?

The United States will immediately suspend entry to the United States of immigrants for 60 days starting from the date of the order. This is the only exception to the suspension:

  • Spouses and children younger than 21 years old are eligible;
  • Persons who are already issued immigrant visas, or have valid travel documents (such a transportation letter or appropriate boarding foil) at the date of the order’s effective date.
  • Lawful permanent residents in the United States
  • Individuals who are applying for immigrant visas as doctors, nurses, or any other healthcare professionals.
  • Adoptive candidates who wish to enter the United States under the IR-4 and IH-4 visa classifications.
  • Any alien whose entry could further the United States law enforcement goals;
  • The United States Armed Forces members and their spouses and children;
  • Persons who enter with a Special Immigrant visa in the SI/SQ classification; and spouses and children.
  • Anyone whose entry would be detrimental to the national interest as determined by the Secretary or Homeland Security Secretary, or their designees.

The order is not applicable to nonimmigrants. This proclamation could be extended beyond 60 days to include other groups of people seeking immigration benefits in the United States. USILG will monitor the situation and notify clients and other stakeholders of any developments.
