On August 12, 2018, the defendant driver made a left turn in front of plaintiff’s motorcycle, at an intersection. Plaintiff was thrown from his motorcycle at 40 mph. He suffered a “open book” pelvic fracture, and a ruptured testicle.

Personal Injuries and Damages

Plaintiff’s Contentions: Plaintiff claimed that defendant was negligent, and that his injuries were caused by such negligence. Plaintiff returned to Marine Corps restricted work four months after the accident. He passed the physical fitness test for active service within eight months. This included pull-ups and crunches, running three miles, and doing pull-ups. He no longer had a limp and began to work out six days per week at the gym. He still suffered from pain and other problems. Although he was active and did not have mobility issues, plaintiff still experienced pelvic pain after extended exercise. He had achieved maximum improvement. The collision also caused plaintiff to experience urinary problems. Although he never received treatment, he stated that the condition is ongoing.

Defendant’s Contentions: Just before the jury selection, defendant agreed to liability. Plaintiff claimed that he had made a remarkable recovery and was active, going to the gym six times a week. Plaintiff’s symptoms were subjective, and there was no objective evidence of the claimed problems. Plaintiff’s symptoms did not match his injuries, according to the urology and orthopedic experts.
